Backup care is subject to caregiver availability and does not guarantee a particular nanny. Families are responsible for paying the nanny directly for hours worked and for their applicable household-employer obligations.

Nannies on the Hudson provides nanny placement, referral, matching, introduction, and related family-support services. The precise legal relationship among the agency, family, and caregiver depends on the service used, the written agreements, and applicable law. Nothing on this website should be read as automatically classifying a caregiver as an independent contractor or as determining employer status.
Where a family is the nanny's employer, the family is responsible for complying with applicable employment requirements, which may include a written employment contract, wage and overtime rules, paid sick leave and breaks, payroll and tax obligations, required records and notices, workers' compensation, and other protections. New Jersey law may impose obligations on hiring entities and may recognize joint-employment relationships based on the actual facts.
New Jersey states that domestic workers can include nannies, childcare providers, and babysitters. Covered employers generally must provide required rights information, and a written contract is generally required when a covered domestic worker works five or more hours per month unless a statutory exception applies.
